Insurance Claim Appraisals

Appraisal Is a Tricky Endeavor
Legal Counsel can Help Reduce the Risks
An "Appraisal" under an insurance policy refers to a specific process in the insurance policy to resolve disputes over the amount of loss. Generally, once a party demands an appraisal of the loss, the carrier and policyholder each appoint an independent estimator, who then try to agree on the amount of loss. If they cannot agree, then a neutral, third-party umpire joins the appraisal panel, and two of the members of the appraisal panel will agree on the amount of loss. Then, the insurance company pays for the damage covered under the insurance policy. Seems simple enough, right? Unfortunately, things are not always as simple as they seem. And that is particularly true when it comes to appraising a disputed insurance claim. Scroll down to learn more about appraising a first-party insurance claim and how we may be able to help you.
I Thought Appraisal was an Alternative to a Lawsuit
So Why Should I Hire an Attorney?
Texas courts have explained appraisal of an insurance claim is the method the parties agreed to use to resolve disputes over the amount of loss and is intended to take place before a lawsuit is filed. And we understand some policyholders have successfully appraised claims on their own without having to file a lawsuit. In fact, many of our clients' claims have been resolved in appraisal without the need for filing a lawsuit. But the facts and circumstances do not always lend themselves to a quick resolution or amicable appraisal of an insurance claim. And that is when experience can really make a difference. Sure, appraisal seems like a simple process, and many people may appear qualified to appraise an insurance claim. But the requirements for appraising an insurance claim may vary depending on the insurance company and their policies. This is when experience really matters.
